1. Agreement to Terms
These Terms of Use (“Terms” or “Agreement”) constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“User,” “you,” or “your”), and KATCHIMEDIA, LLC (“Company,” “we,” “us,” or “our”), concerning your access to and use of The Trigger Tracker™ web application, mobile applications, and all related software, backend systems, database infrastructure, and electronic services (collectively, the “Service”).
By creating an account, accessing, or utilizing the Service in any manner, you acknowledge that you have read, understood, and agree to be bound by all of these Terms. If you do not agree with all of these Terms, you are expressly prohibited from using the Service and must discontinue use immediately.
If you are entering into this Agreement on behalf of a company, organization, or other legal entity, you represent and warrant that you have the full legal authority to bind such entity to these Terms, in which case the terms “User,” “you,” or “your” shall refer to such entity.
2. Eligibility & Capacity
2.1 Age Requirement: You must be at least 18 years of age to create an account or use the Service. We do not knowingly collect, solicit, or maintain personal data or special category information from individuals under the age of 18. If we become aware that an individual under 18 has created an account or provided sensitive physiological or behavioral logs, we will immediately terminate their account and permanently delete all associated data within our systems.
2.2 Legal Capacity: You represent and warrant that you possess the full legal capacity to enter into this contract under the laws of your applicable jurisdiction. If you are subject to a guardianship, conservatorship, or other legal disability, you may not utilize this Service unless a legally authorized representative has reviewed and explicitly consented to these Terms.
3. Medical, Crisis, & Domestic Violence Disclaimers

The Trigger Tracker™ is a digital self-monitoring tool designed to help users track physiological, cognitive, and environmental responses to psychological stressors or trauma-related indicators. It is NOT a medical device, nor is it a clinical healthcare platform.
The Service does NOT:
- Provide clinical, psychiatric, psychological, or medical diagnoses, treatments, cures, or prevention protocols.
- Replace or substitute face-to-face or telehealth clinical psychotherapy, psychiatric intervention, or professional medical evaluation.
- Establish a physician-patient, therapist-client, or clinician-user relationship of any kind.
Any AI-generated insights, reframes, or outputs produced by the Anthropic Claude API (specifically via our “generate-reframe” personalization feature) are strictly for educational and cognitive self-reflection purposes. They do not constitute clinical advice, psychiatric diagnoses, or recommended therapeutic interventions. Always consult a licensed psychological or medical professional regarding mental health concerns.
3.1 Crisis & Self-Harm Disclaimer: You explicitly acknowledge and agree that the Service is not designed, intended, or equipped to respond to mental health crises, acute psychological distress, or self-harm/suicidal ideation emergencies. The Service does not actively monitor, compute, detect, or escalate indicators of suicidal intent or imminent self-harm.
3.2 Immediate Emergency Protocol: If you believe you are in immediate physical danger, are experiencing a medical or mental health emergency, or are having thoughts of self-harm or suicide, you must contact local emergency services or localized crisis networks immediately. The following non-affiliated public resources are available for immediate assistance:

No user logs, journal entries, or trigger tracking data generated within this app function as a safety or protective system against active interpersonal threats.
4. Assumption of Risk & System Limitations
4.1 Emotional and Physiological Volatility: By using the Service to log, document, and analyze traumatic triggers, environmental stressors, and physiological responses, you assume all inherent psychological risks. Reviewing historical data, engaging with AI-powered cognitive reframing components, or interacting with past journal entries may temporarily induce emotional discomfort, flashback episodes, or exacerbation of existing psychological symptoms. You agree to employ the tool at your own pace, preferably under the guidance of a licensed behavioral health professional.
4.2 Security & Data Limits: Despite our integration of enterprise-grade cloud security infrastructure (including Next.js frameworks, Supabase multi-tenant row-level security isolation, Vercel deployments, and AES-256 database encryption protocols), no digital transmission or data storage system is entirely impenetrable. You acknowledge that data corruption, localized network synchronization failure, or unauthorized system breaches could theoretically occur. You assume the risk of relying on the persistence or absolute confidentiality of historical data, and you are advised to export your machine-readable logs regularized through our in-app data portability features.
5. Accounts, Registration, & Credentials
5.1 Account Security: To unlock the features of the Service, you must register an account by providing a valid, verified email address and generating a secure password. You are entirely responsible for maintaining the strict confidentiality of your login credentials and for any and all activities occurring under your account. You agree to notify us immediately at privacy@katchimedia.com if you suspect unauthorized access or credential theft.
5.2 Anonymization & Pseudonymity: We support your right to privacy. You are permitted to register an account using a pseudonymous email address and profile designation to maintain layer-one confidentiality, provided that your email address is fully operational for functional system updates, legal notifications, and Stripe billing processing.
5.3 Account Deletion & Data Retention: You may request complete account deletion at any time through your in-app settings interface. Upon initiating deletion, your account status will transition to a deactivated state, and all personal identifiers, trigger logs, and journal entries will be systematically and permanently purged from our active PostgreSQL production databases within 30 days, subject only to localized statutory backup cycles and mandatory tax/billing retention constraints enforced via Stripe.
6. Subscriptions, Payments, Billing, & Auto-Renewal
6.1 Tier Structure: The Service operates on a tiered operational matrix consisting of a standard Free Tier with limited data-logging boundaries and a Premium Annual Plan.
6.2 Premium Annual Plan Pricing: The Premium Annual Plan is priced at $125.00 USD per year (equivalent to an amortized rate of approximately $10.42 USD per month), billed as a singular, upfront annual transaction.
6.3 Free Trial Structure: New subscribers may be granted a 7-day promotional free trial. A valid payment method must be provided to Stripe at the time of trial enrollment. Upon expiration of the 7-day trial period, the specified payment method will be automatically, systematically charged the full $125.00 USD annual rate, unless the subscription is explicitly canceled at least 48 hours prior to the trial’s expiration date via the Stripe Customer Portal link inside your app settings.
6.4 Price Guarantees & Cohort Locks: For users who enroll during the early-access launch window (the Initial Launch Cohort), the Company guarantees a perpetual Price Lock Upgrade. Your subscription renewal rate will remain permanently capped at $125.00 USD per year for the lifetime of your continuous, uninterrupted account existence, immune to future platform price increases.
6.5 Automated Billing & Auto-Renewal: Premium subscriptions automatically renew at the end of each annual billing cycle. You authorize Stripe, our primary PCI-DSS compliant payment processing partner, to collect the applicable annual subscription fees, plus any applicable localized value-added tax (VAT) or general sales tax (GST), utilizing the active payment method on file.
6.6 Cancellation & Refunds: You can cancel your subscription auto-renewal at any time through the in-app customer billing portal. Cancellation stops future automated renewals but does not trigger retroactive refunds for partial-year usage, except as expressly provided under localized consumer protection regulations or if a technical billing anomaly occurs.
7. Intellectual Property Rights & Licensing
7.1 Ownership of the Service: The Trigger Tracker™ name, the application codebase (Next.js, TypeScript, React, Tailwind CSS styles, Supabase Edge Functions), custom branding elements, system architecture, interfaces, icons (Lucide), dropdown components (Radix UI), and automated logo visual assets generated via Python/Pillow are the exclusive intellectual property of KATCHIMEDIA, LLC or its licensing partners. You are granted a limited, non-exclusive, non-transferable, revocable license to access and interact with the web application for personal, non-commercial use.
7.2 Ownership of User Data: You retain full, uncompromised legal ownership and copyright over all textual content, raw data logs, personal entries, sensation mappings, and custom journal inputs you submit to the Service (“User Content”). The Company acquires no proprietary rights or ownership stakes in your raw emotional tracking data.
7.3 Limited Operational License Grant: To deliver the Service effectively—specifically to parse text payloads, securely transmit raw logs to database infrastructure, and execute the “generate-reframe” personalization functionality via the Anthropic Claude API—you hereby grant the Company a narrow, non-exclusive, royalty-free, worldwide license to process, store, securely transmit, and algorithmically transform your User Content. This license exists solely for functional execution of the application and is immediately revoked upon account deletion.
8. Prohibited Uses & System Restraints
You agree not to exploit the platform or participate in activities that damage system stability or user safety. Forbidden behaviors include:
- Reverse Engineering: Attempting to decompile, reverse engineer, extract, or clone the application architecture, Next.js components, or underlying algorithm arrays.
- Automated Scraping: Employing bots, crawlers, spiders, scripts, or advanced programmatic APIs to scrape, aggregate, index, or extract data from the Service without express written consent.
- Malicious Inputs: Transmitting viruses, malware, logic bombs, trojan horses, or executing continuous webhook exploitation attempts designed to flood Supabase edge functions or Stripe endpoints.
- Harassment & Exploitation: Using the open text journal entries or trigger fields to store unlawfully obtained, defamatory, abusive, or explicitly harmful materials, or utilizing system workflows to disrupt the network integrity of Vercel or GitHub source registries.
9. Geographic Restraints & Export Control Compliance
The Service is hosted in the United States via Vercel and Supabase cloud facilities. By utilizing the platform, you represent and warrant that you are not a citizen or resident of any country subject to comprehensive U.S. Office of Foreign Assets Control (OFAC) sanctions (currently including, but not limited to, Cuba, Iran, North Korea, Syria, and the Crimea, Donetsk, or Luhansk regions of Ukraine). Furthermore, you warrant that you are not listed on any U.S. government restricted parties list, including the Specially Designated Nationals (SDN) List. If you access the Service from outside the United States, you are solely responsible for ensuring complete compliance with all local laws and data localization restrictions.
10. Limitation of Liability & Indemnification
10.1 Disclaimer of Warranties: THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. THE COMPANY EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT AI-GENERATED REFLEXIVE OUTPUTS WILL BE PSYCHOLOGICALLY BENEFICIAL, FREE FROM ERROR, ACCURATE, OR APPLICABLE TO YOUR SPECIFIC STRESS FACTORS.
10.2 Monetary Limitation Cap: EXCEPT AS EXPRESSLY REQUIRED BY APPLICABLE LAW (INCLUDING GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR PROVEN BREACH OF SECURITY DIRECTLY CAUSED BY ADJUDICATED CRIMINAL INTENT OF THE COMPANY), THE AGGREGATE LIABILITY OF KATCHIMEDIA, LLC FOR ANY CLAIMS ARISING OUT OF THESE TERMS, WHETHER IN CONTRACT, TORT, OR STRICT LIABILITY, SHALL BE STRICTLY LIMITED TO THE LESSER OF: (A) THE TOTAL AMOUNT ACTUALLY PAID BY YOU TO THE COMPANY IN SUBSCRIPTION FEES DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR (B) $100.00 USD.
11. Dispute Resolution, Mandatory Arbitration, & Class Action Waiver
11.1 Mandatory Binding Arbitration: You and KATCHIMEDIA, LLC agree that any legal dispute, claim, or controversy arising out of or relating to these Terms, the breach thereof, or the use of the Service shall be settled via mandatory, binding individual arbitration administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules. The arbitration shall take place in Atlanta, Georgia, and shall be conducted in the English language.
11.2 Class Action Waiver: YOU AND THE COMPANY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person’s claims or preside over any class or representative action.
11.3 30-Day Opt-Out Window: You possess the legal right to opt out of this mandatory arbitration provision. To opt out, you must transmit a signed, written statement detailing your explicit intent to opt out, sent via email to privacy@katchimedia.com or via post to our designated physical address within 30 days of creating your initial account.
12. Miscellaneous Legal Provisions
12.1 Governing Law: These Terms shall be construed, interpreted, and governed exclusively by the laws of the State of Georgia, United States, without regard to its conflict of law principles.
12.2 Severability: If any provision of these Terms is deemed unlawful, void, or for any reason unenforceable by a court or arbitrator of competent jurisdiction, that provision shall be severed from the remaining Terms and shall not impact the validity or enforceability of the remaining sections.
12.3 Force Majeure: The Company shall not be held liable or responsible for system downtime, data transmission blockages, or failure to perform obligations under these Terms resulting from acts of God, pandemics, localized internet/cloud provider infrastructure failures (Vercel, Supabase, AWS, or Stripe routing outages), cyber warfare, ransomware encryption, or government mandates.
12.4 Complete Integration: These Terms, alongside our Privacy Policy, Cookie Policy, and DMCA Policy, constitute the absolute and final contractual understanding between you and KATCHIMEDIA, LLC regarding The Trigger Tracker™ platform.
